Romania introduces the obligation to register import sensitive goods – non-compliance will result in high fines

The purpose of the RO e-Transport system implemented by the Romanian authorities is to improve the collection of taxes and fees to the state budget and prevent and combat illegal trade in goods.

From 1 July, import sensitive goods with a high fiscal risk have to be registered in the National Road Transport Monitoring System (RO e-Transport), which was created by the Ministry of Finance in cooperation with the National Tax Administration Agency (ANAF) and the Romanian Customs Administration

The following goods with a high fiscal risk, which are transported by road, are monitored via the RO e-Transport System:
1. Vegetables, plants, roots and tubers, fodder classified under CN codes 0701 to 0714 inclusive
2. Edible fruit; peel of citrus fruit or melons classified under CN codes 0801 to 0814 inclusive
3. Beverages, alcoholic beverages and vinegar classified under CN codes 2201 to 2208 inclusive
4. Salt; sulfur; earth and stones; gypsum, lime and cement classified under CN codes 2505 and 2517
5. Articles of apparel and clothing accessories, knitted or crocheted, classified under CN codes 6101 to 6117 inclusive
6. Articles of apparel and clothing accessories, other than knitted or crocheted, classified under CN codes 6201 to 6212 inclusive and CN codes 6214 to 6217 inclusive
7. Footwear, gaiters and similar articles; parts of these articles classified under CN codes 6401 to 6405 inclusive
8. Cast iron, iron and steel classified under CN codes 7213 and 7214

The following entities are required to register in the RO e-transport system
◾beneficiaries of an intra-Community acquisition, a supplier in the case of intra-Community deliveries;
◾Importers or exporters who are entered in the customs declarations for import and export operations;
◾suppliers in the case of goods traded locally;
◾ depositaries in the case of goods that are involved in intra-Community transactions in transit.

Sanctions:
If the driver of a transport vehicle refuses to present the ITU code at the request of a representative of the National Tax Administration Agency or the Romanian Customs Office, they are subject to a fine ranging from 5,000 to 10,000 lei. (1 lei is currently EUR 0.2 )

If the driver fails to verify the validity of the ITU code and continues to travel beyond its 5-day validity period, the carrier will be subject to a penelty ranging from 10,000 to 50,000 lei for natural persons or from 20,000 lei to 100,000 lei for juridical persons, and the confiscation of the value of undeclared property.

Failure to declare all general cargo transported by the truck, if it contains high-risk goods, is punishable by a fine of 10,000 lei to 50,000 lei for natural persons or a fine of 20,000 lei to 100,000 lei for juridical persons.
